The court today delivered its verdict in the petition filed by Silva accusing Weerawansa of violating Intellectual Property Rights through the publishing of his book titled ‘Naththa Wenuwata Aththa’.
Accordingly, Colombo Commercial High Court ordered MP Wimal Weerawansa to pay Rs 10 million in compensation to JVP General Secretary Tilvin Silva.
Silva noted that even a JVP Pradeshiya Sabha member does not obtain any salary or allowance of any kind, noting that this case was filed based on the violation caused to the party’s intellectual rights.
The case was filed by the General Secretary of the JVP Tilvyn Silva, while the courts imposed an injunction preventing the publication of this book.
Tilvin Silva had alleged that the book published by former JVP member Wimal Weerawansa had included certain ideas and proposals presented by him to the executive committee of the Janatha Vimukthi Peramuna (JVP), during the time when the latter was still a member of the party and filed the case in 2008.
Having considered the presented facts, the Commercial Courts issued an injunction preventing the publication of the book and awarded all rights of the said book to Tilvyn Silva under the intellectual property rights.
Former JVP leader Somawansa Amarasinghe had also filed a case against Weerawansa in the Commercial Courts. However, after his departure from the JVP, Somawansa had struck an agreement with Weerawansa and had withdrawn the case.
Attorney Shanika Silva, Attorney Sunil Watagala and a group of lawyers appeared for the plaintiff.
The court ordered Weerawansa to pay all legal costs to the plaintiff and to take measures to pay the price of all the books sold so far.
Weerawansa was also ordered to destroy all the copies of the book printed so far.
